Terms and Conditions

Article 1: General Provisions
This e-commerce webshop offers its customers the possibility to purchase products from its online store. These General Terms and Conditions (“Terms”) apply to any order placed by a visitor of this e-commerce webshop (“Customer”). Any additional conditions from the Customer are excluded unless these have been explicitly accepted in writing in advance.

Article 2: Price
All prices are quoted in euros and, unless otherwise stated, include VAT. If delivery, reservation, or administrative fees are charged, this will be specified separately. The price applies solely to the items as described in the text. The accompanying photos are for decorative purposes and may contain items that are not included in the price.

Article 3: Offer
Although the online catalog and the e-commerce webshop are prepared with the utmost care, it is still possible that the offered information is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding. The seller is in no way liable in case of manifest material errors, typographical errors, or printing mistakes. If the Customer has specific questions about, for example, size, color, availability, delivery time, or delivery method, we ask the Customer to contact our customer service in advance. The offer is always valid while stocks last and can be modified or withdrawn at any time. The seller cannot be held liable for the unavailability of a product.

Article 4: Online Purchases
The Customer can choose to pay via bank transfer or credit card. The seller is entitled to refuse an order due to a serious shortcoming on the part of the Customer regarding orders in which the Customer is involved.

Article 5: Delivery and Execution of the Agreement
Any visible damage and/or quality shortcoming of an item or any other defect in delivery must be reported by the Customer immediately. The risk of loss or damage is transferred to the Customer as soon as they (or a third party designated by them, who is not the carrier) physically take possession of the goods.

Article 6: Retention of Title
The delivered items remain the exclusive property of the seller until full payment has been made by the Customer.

Article 7: Right of Withdrawal
The provisions of this article apply only to Customers who purchase items online as consumers. The consumer has the right to withdraw from the agreement within 2 calendar days, unless otherwise specified, without providing any reason, provided that the right of withdrawal applies to the item or service ordered by the Customer. For hygiene reasons, headscarves cannot be returned or exchanged. The right of withdrawal does not apply to these items. To exercise the right of withdrawal, the Customer must notify the seller via an unambiguous statement (e.g., in writing by post or email) of their decision to withdraw from the agreement. The Customer must return or hand over the goods immediately after their decision to withdraw from the agreement. The direct costs of returning the goods are borne by the Customer unless otherwise agreed. If the returned product has in any way been reduced in value, the right is reserved to hold the Customer liable and claim compensation for any depreciation. Only items in their original packaging, with all accessories and the invoice or proof of purchase can be returned. In case the agreement involves the provision of services, and the Customer has requested the services to begin during the withdrawal period, the Customer will pay an amount proportional to what has already been delivered at the time they informed us of their decision to withdraw from the agreement, compared to the full execution of the agreement.

Article 8: Warranty
Under the law of September 21, 2004, regarding the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. To claim the warranty, the Customer must present proof of purchase. The (commercial and/or legal) warranty does not apply to defects resulting from accidents, neglect, falls, use of the item contrary to its intended purpose, failure to follow the user instructions or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use.

Article 9: Sanctions for Non-Payment
Without prejudice to the exercise of other rights, the Customer shall owe interest on the unpaid amount from the date of default, automatically and without the need for a reminder. Notwithstanding the foregoing, the right is reserved for the non (fully) paid items to be reclaimed.

Article 10: Privacy Policy
The seller reserves the right to collect user data solely for internal use, both directly through data provided by the user at the time of the order and indirectly (e.g., via the use of cookies, which are small data strings on the user’s computer that allow the seller to optimize the content and layout of the site to better suit the user). This data will not be shared with organizations contractually bound to the seller. In accordance with the law of December 8, 1992, on the protection of personal data, the user has the right at any time to access, modify, correct, and delete this data if they no longer wish to receive information regarding our activities. To do so, they can contact the seller’s customer service in writing.

Article 11: Invalidity of Provisions – Non-Waiver
If a provision of these Terms is declared invalid, illegal, or void, this will not affect the validity, legality, and applicability of the other provisions. The seller’s failure to enforce any of the rights listed in these Terms or to exercise any right hereunder will not be deemed a waiver of such provision and will not affect the validity of these rights.

Article 12: Modification of Terms
These Terms are supplemented by other terms to which explicit reference is made, and the seller’s general sales terms. In case of contradiction, these Terms will prevail.

Article 13: Applicable Law
Belgian law applies. The courts of the seller’s place of residence have jurisdiction in the event of judicial disputes. The seller may also resort to the ODR platform.
